TERMS AND CONDITIONS

In an effort to ensure fair and honest public feedback, and to prevent the publishing of libelous content in any form, your acceptance of this contract prohibits you from taking any action that negatively impacts Good Tidings Plumbing, Heating, and Cooling, Inc its reputation, products, services, management or employees. Should you violate this clause, as determined with Good Tidings PHC, Inc. in its sole discretion, you will be provided a seventy-two (72) hour opportunity to retract the content in litigation. If the content remains, in whole or in part, you will be billed $3,000 for legal fees and court costs until such complete costs are determined in litigation. Should these charges remain unpaid for 30 calendar days from the billing date; your unpaid invoice will be forwarded to our third-party collection firm and will be reported to consumer reporting agencies until paid.
RESPONSIBILITIES OF CUSTOMER:
Customer represents that, except as described in the request for service, all plumbing, heating, air conditioning, electrical and drain systems are in good repair and condition and agrees to hold seller harmless for the discovery of defective conditions, including but not limited to the following:

1. Improper or faulty plumbing
2. Rusted or defective pipes
3. Acids in the drain system
4. Hardened mineral deposits
5. Lines that are settled or broken
6. Existing illegal conditions
7. Improperly charged systems
8. Faulty air movement
9. Electrical defects
10. Improper or faulty electrical
11. Improper voltage by power company
12. Improper or failing chimney

RESPONSIBILITIES OF SELLER:
Seller shall do all work in a competent, workmanlike manner. Seller is not responsible for any existing illegal conditions.
LIMITED WARRANTY:
New Installations – 1 year*, Plumbing, Heating/AC repairs – 90 days*. Kitchen, lavatory, laundry, tub drain cleaning – 90 days**. Toilet, main/sewer drain cleaning – No Warranty!
All warranties are void if payment is not made when due. Warranties extend only to the customer and are not transferable. If a defect in materials or workmanship covered by this warranty occurs, Seller will, with reasonable promptness during normal working hours, remedy the defect. In no event shall Seller be held liable for water or other damage caused by any delay in remedying a defect. To obtain warranty performance, notify the Seller of any defect or claim for breach at the address and telephone number on the face hereof.
*Work done by others voids warranty.
**Garbage disposals, tubs or showers without strainers, missing sink stoppers, hardened mineral deposits, root infestation, sanitary products, and other foreign items, and improper or failing piping, etc. voids all warranties.

EXCLUSIONS AND LIMITATIONS:
CUSTOMER’S RIGHT TO REPAIR AND REPLACEMENT ARE CUSTOMER EXCLUSIVE REMEDIES. SELLER SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.
Seller is not responsible for the following which are excluded from the coverage of this limited warranty:
1. Defective conditions listed under the above “Responsibilities of Customer”.
2. Work performed by or materials installed by others, not in this agreement.
3. Defects and failures from mistreatment or neglect or otherwise not caused by defect in Seller’s materials or workmanship.
4. Mold development or mold detection of any kind.
“THE LIMITED WARRANTY STATED ABOVE IS THE ONLY WARRANTY SELLER MAKES. SELLER MAKES NO WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE FOR GOOD SOLD, OR ANY OTHER WARRANTY, EXPRESS OR IMPLIED. ”
PROTECTION OF CUSTOMER PROPERTY:
Customer agrees to remove or protect any personal property, inside and out, including but not limited to carpets, rugs, shrubs, and planting, and Seller shall not be responsible for said items. Nor shall Seller be held responsible for the natural consequences of Sellers work which may cause damage to improvements to real property including, but not limited to, curbs, sidewalks, driveways, garages, patios, lawns, shrubs, sprinkler systems, wallpaper, drywall, stucco, tile, cabinets, and other appurtenances to the residence or real property.
Seller shall not be held responsible for damage to personal property, or any improvements to real property caused by persons delivering materials or equipment, or keeping gates and doors closed for children and animals.
ENTIRE AGREEMENT:
This is the entire agreement. The parties are not bound by any oral expression or representation by agent purporting to act for on their behalf, or by any commitment, or arrangement herein. The agreement binds jointly and severally all signing as Customers, their heirs, representations, successors and assigns. Seller will not provide an itemized breakdown of materials and labor.
WARRANTIES, AND LIMITATIONS OF WARRANTIES:
No warranty expressed or implied, is provided for any existing systems or appliances. Any alterations, additions, or repairs made by others unless authorized or agreed upon by seller, will be caused to terminate Sellers obligation under this contract.

I hereby authorize the work described and agree to the Terms and Conditions I recognize that aged and deteriorated equipment, heating systems, cooling systems, plumbing fixtures, piping, and appurtenances may no longer be serviceable. When necessary, I agree to pay for permits, arrange for and accommodate inspections, and I have the authority to order said work. A service charge of 1-1 ½ % per month (18% annum) will be charged on the balances 30 days or more past due.

I have inspected all of the work done by Good Tidings Plumbing, Heating, and Cooling pursuant to the contract terms agreed by me at Dana Lewisohn. I find that all work has been completed in a satisfactory and workmanlike manner. I have been given the opportunity to address concerns and/or discrepancies in the work provided, and I either have no such concerns or have found no discrepancies, or they have been addressed by Good Tidings Plumbing, Heating, and Cooling to my satisfaction. By signature here signifies my full and final acceptance of all work performed by the contractor pursuant to the contract as agreed.

I authorize Good Tidings Plumbing, Heating, and Cooling to charge the agreed amount to my credit card provided herein. I agree that I will pay for this purchase in accordance with the issuing bank cardholder agreement.
